Terms of Service

These terms cover Soon: Preorder & Back in Stock, and any other Shopify app published by Drozium.

1. Agreement

By installing or using one of our apps you agree to these terms. In them, “we” and “Drozium” mean Drozium; “you” means the Shopify store owner or staff member who installs or uses the app; “shopper” means a customer of your store.

If you do not agree with these terms, uninstall the app. Continuing to use it means you accept them.

2. The service

Soon sends back-in-stock alerts to shoppers who ask to be notified, and lets you sell products before stock arrives using Shopify's preorder selling plans. It runs inside your Shopify admin and adds a storefront embed to your theme.

We add, change and remove features over time. We will not remove a feature you are actively relying on without telling you first through the app or by email.

3. Your responsibilities

You are responsible for:

  • The accuracy of your product, inventory and pricing data. We act on what Shopify reports; we do not verify it.
  • The content of messages sent from your store, including any wording you customise, and for having a lawful basis to message shoppers who sign up.
  • Fulfilling preorders you accept. Preorder payments are taken through Shopify and settle to your account, not ours — we never hold your money or your shoppers'.
  • Complying with the laws that apply to your store, including consumer, marketing and data protection law in the places you sell.

4. Plans, billing and cancellation

Paid plans are billed through the Shopify Billing API and appear on your Shopify invoice. We never see or store your card details.

  • The Free plan has monthly limits on alerts and on the number of products you can offer for preorder. Current limits are shown on the Plans page in the app.
  • Paid plans include a free trial. If you cancel during the trial you are not charged.
  • You can change or cancel your plan at any time from the Plans page or from your Shopify admin. Cancellation takes effect at the end of the current billing period; Shopify does not prorate refunds and neither do we.
  • If you move to a plan with lower limits while you are over them, we do not switch anything off immediately. You get a clearly-dated grace period, shown in the app, to choose what to keep.
  • We may change prices. Existing subscribers get notice through the app or by email before a change takes effect, and can cancel instead.

5. Data

What we collect, why, how long we keep it and how to have it deleted is set out in our Privacy Policy, which forms part of these terms.

In short: for shopper data collected through your storefront you are the controller and we are your processor; we do not sell it, and we do not use it to market anything of our own. Uninstalling the app deletes your data on the schedule described in that policy.

6. Acceptable use

You agree not to use the app to:

  • Send unsolicited marketing. Restock alerts are transactional messages a shopper asked for, and must not be repurposed as a mailing list.
  • Upload contacts you obtained elsewhere, or subscribe anyone without their request.
  • Take preorders for products you do not intend to ship.
  • Attempt to circumvent plan limits, interfere with the service, or access data belonging to another store.

We may suspend an account that does these things. Where the situation allows it, we will tell you first and give you a chance to put it right.

7. Availability

We work to keep the app running and monitor it, but we do not offer a guaranteed uptime level. Alert delivery also depends on Shopify, on email and messaging providers, and on receiving mail servers — none of which we control. “Delivered” in the app means the receiving server accepted the message, not that a shopper read it.

We may take the service down for maintenance. Where downtime is planned and material, we will give notice.

8. Liability

The app is provided “as is”. To the extent the law allows, we exclude implied warranties and are not liable for lost profits, lost sales, lost data, or indirect or consequential loss.

Where we are liable, our total liability in any twelve-month period is limited to what you paid us for the app in that period. Nothing here excludes liability that cannot lawfully be excluded.

9. Termination

You can stop at any time by uninstalling the app from your Shopify admin. Uninstalling cancels any active subscription through Shopify and starts the data deletion described in the Privacy Policy.

We may terminate or suspend access if you breach these terms, or if we stop offering the app. If we discontinue the app we will give reasonable notice so you can export your data.

10. Changes to these terms

We may update these terms. The date at the top shows when they last changed. For material changes we will notify you in the app or by email before they take effect. Continuing to use the app after that means you accept the updated terms.
